Membership Terms & Conditions

These terms are effective upon membership enrollment and govern all membership plans offered by Rolling Stone Elite Massage & Wellness.

These Membership Terms & Conditions ("Agreement") govern all membership plans offered by Rolling Stone Elite Massage & Wellness ("Rolling Stone Elite," "Company," "we," "our," or "us"). By purchasing or participating in any membership plan, you ("Member," "Client," or "you") agree to the following terms.

1. Membership Overview

Rolling Stone Elite memberships are recurring wellness plans that provide members with discounted massage and wellness services, member-exclusive benefits, and priority booking privileges.

Membership benefits may include, but are not limited to:

  • Monthly massage session credits

  • Discounted rates on additional services

  • Member-only promotions or add-ons

  • Priority scheduling access

  • Access to select wellness offerings

Specific membership details, pricing, and benefits are listed at the time of purchase and may be updated periodically in accordance with Section 9 of this Agreement.

 

 

2. Automatic Billing Authorization

 

By enrolling in a membership, you authorize Rolling Stone Elite to automatically charge your designated payment method on a recurring monthly basis until canceled in accordance with this Agreement.

You agree that:

  • Billing will occur automatically each month on your original signup date or nearest applicable processing date.

  • You are responsible for maintaining a valid payment method on file at all times.

  • Failed or declined payments may result in suspension or cancellation of membership benefits until payment is resolved.

  • Rolling Stone Elite reserves the right to retry failed payments and charge any outstanding balances owed.

  • Your enrollment constitutes a valid electronic authorization under Georgia’s Uniform Electronic Transactions Act (O.C.G.A. § 10-12-1 et seq.), and your digital acceptance of these terms carries the same legal effect as a handwritten signature.

 

 

3. Membership Commitment & Cancellation

 

Memberships are a 3-month initial commitment and then month-to-month unless otherwise specified at the time of enrollment.

You may cancel your membership by providing written notice at least seven (7) days before your next billing date. Cancellation requests submitted after that period may result in one final charge before cancellation becomes effective.

Cancellation requests must be submitted through the member portal or the designated cancellation channel provided at time of enrollment.

No refunds will be issued for:

  • Partial billing cycles

  • Unused sessions

  • Missed appointments

  • Failure to schedule services

Exception: In the event Rolling Stone Elite cancels a scheduled appointment or is unable to provide a booked service, the Member will be offered a reschedule or session credit at the Member’s option. This provision is intended to ensure fairness and compliance with Georgia’s Fair Business Practices Act (O.C.G.A. § 10-1-390 et seq.).

 

 

4. Session Usage & Expiration

 

Membership sessions and credits are intended solely for the active member unless otherwise explicitly stated.

Unused sessions:

  • May roll over as specified in your active membership plan. Rollover terms, if applicable, are defined at the plan level and communicated at time of enrollment.

  • Expire upon cancellation of membership unless otherwise stated in writing.

  • Have no cash value and may not be redeemed for cash, credit, or refunds.

 

 

5. Appointment Scheduling & Late Policy

 

Appointments are subject to availability. While members may receive scheduling priority, Rolling Stone Elite does not guarantee specific appointment dates or times.

Members agree to provide at least 24 hours’ notice for cancellations or rescheduling.

Late cancellations, no-shows, or arriving excessively late may result in:

  • Forfeiture of that session credit

  • Applicable cancellation fees

  • Reduced session time

If a client arrives late, the session may end at the originally scheduled time to avoid disrupting other appointments.

 

 

6. Mobile Services

 

Certain memberships may include or allow mobile massage services. Mobile appointments may:

  • Include travel fees outside designated service areas

  • Require safe, clean, and appropriate working conditions

  • Be declined or terminated if the therapist determines that conditions are unsafe, unsuitable, or otherwise professionally inappropriate

In the event a mobile session is terminated by Rolling Stone Elite due to unsafe or unsuitable conditions, the session fee remains non-refundable. Rolling Stone Elite reserves the right to refuse or discontinue service at any location at its sole discretion.

 

 

7. Medical Disclaimer

 

Massage therapy and wellness services provided by Rolling Stone Elite are intended for relaxation, stress reduction, and general wellness purposes only. Services are not intended to diagnose illness, prescribe treatment, replace medical care, or serve as physical therapy or chiropractic treatment unless explicitly licensed and stated.

Clients are responsible for informing Rolling Stone Elite of:

  • Medical conditions

  • Injuries or surgeries

  • Pregnancy

  • Medications

  • Any other health concerns that may affect treatment

Members understand that massage therapy may not be appropriate for all individuals or conditions. Rolling Stone Elite is not a covered healthcare entity under HIPAA; however, any health information collected is handled with strict confidentiality and in accordance with our Privacy Policy, which is incorporated herein by reference.

 

 

8. Professional Boundaries & Conduct

 

Rolling Stone Elite maintains a strictly professional wellness environment. Any inappropriate behavior, sexual misconduct, harassment, intoxication, illegal activity, or behavior deemed unsafe or disrespectful may result in:

  • Immediate termination of the session

  • Immediate cancellation of membership without refund

  • Refusal of future services

Rolling Stone Elite reserves the right to refuse service to anyone at its discretion and in accordance with applicable law.

 

 

9. Membership Changes

 

Rolling Stone Elite reserves the right to modify pricing, adjust membership benefits, change service offerings, or update policies or terms at any time. Reasonable advance notice will be provided for material changes. Continued use of membership services after changes take effect constitutes acceptance of the revised terms.

 

 

10. Freeze or Pause Requests

 

Membership freezes or temporary pauses may be granted at Rolling Stone Elite’s sole discretion for qualifying circumstances including medical issues, extended travel, or emergencies. Approval is not guaranteed and may require advance notice and supporting documentation.

Approved freezes shall not exceed ninety (90) consecutive days. Upon expiration of an approved freeze period, billing will resume automatically unless the member takes affirmative action to cancel in accordance with Section 3.

 

 

11. Liability Waiver

 

To the fullest extent permitted under Georgia law, Member voluntarily assumes all risks associated with massage and wellness services. Member agrees to release and hold harmless Rolling Stone Elite Massage & Wellness, its owners, contractors, employees, and affiliates from claims arising out of:

  • Participation in services

  • Injuries or reactions occurring during or after services

  • Undisclosed medical conditions

  • Client negligence

Nothing in this Agreement shall waive rights that cannot legally be waived under Georgia law.

 

 

12. Dispute Resolution & Binding Arbitration

 

Any dispute, claim, or controversy arising out of or relating to this Agreement, including the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively through binding arbitration administered by a mutually agreed-upon arbitrator in accordance with the rules of the American Arbitration Association (AAA) or JAMS, as selected by the initiating party.

Arbitration shall take place in Atlanta, Georgia. The arbitration proceedings, all filings, testimony, documents, and any award or decision shall be kept strictly confidential by all parties, except as necessary to enforce an award or as required by law.

Each party shall bear its own costs and attorneys’ fees unless the arbitrator determines otherwise. The arbitrator’s decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

Nothing herein prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction pending arbitration.

 

 

13. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia. To the extent any matter proceeds in court rather than arbitration, the parties consent to jurisdiction in the appropriate courts located in Cobb County, Georgia, unless otherwise required by law.

14. Entire Agreement

These Terms & Conditions constitute the entire agreement between the Member and Rolling Stone Elite regarding membership participation and supersede any prior verbal or written agreements related to membership services. This Agreement is intended to be read in conjunction with the Rolling Stone Elite Privacy Policy, Consent to Treatment / Intake Waiver, and any applicable Mobile Service Safety Policy, each of which are incorporated by reference.

This document is a blanket governing agreement effective upon enrollment. Contact information, service locations, and plan-specific details are provided separately at time of enrollment.
